Employer Certification

Employment Background Check reports ordered from AAA Credit Screening Services are FCRA - Fair Credit Reporting Act compliant and to maintain that compliance, clients will be asked to complete an Employer Certification Form.

Consumer Reporting Agencies such as AAACSS can only supply reports for employment purposes if:

“the person who obtains such report from the agency certifies to the agency that […] (i) a clear and conspicuous disclosure has been made in writing to the consumer at any time before the report is procured or caused to be procured, in a document that consists solely of the disclosure, that a consumer report may be obtained for employment purposes; and (ii) the consumer has authorized in writing […] the procurement of the report by that person” (§ 604 – 15 U.S.C. § 1681b)"

The employer certification form tells AAACSS that the employer has provided the candidate with the required disclosures and obtained their authorization before requesting employment screening reports on that applicant.

This form must be completed every time an employment background check report is ordered. Our other forms such as the Client Services Agreement (CSA) and Criminal Reporting Policies Form are one-time requirements to sign your company up as a client with AAA Credit Screening Services. Unfortunately the Federal Trade Commission (FTC) who controls the FCRA has stated that a "blanket certification" is not sufficient for running reports on multiple individuals. It is however acceptable to use the original employer certification used for a specific applicant during their tenure with the company.
